1. About SchemaCart and these Terms
SchemaCart is operated by Benjamin Ong, a sole trader in Hong Kong trading as SchemaCart. These Terms of Service (“Terms”) govern the SchemaCart website, free URL scans, email-gated reports, monitoring subscriptions, one-time audits, and related services (together, the “Services”). “You” means the person using a Service and any organisation that person represents.
By submitting a scan, accepting an order, creating an account, or using a Service, you agree to these Terms and the Privacy Policy. If you act for an organisation, you confirm you can bind it. If you do not agree, do not use the Services.
The free scanner and paid Services are intended for website owners, operators, merchants, and professionals acting for business purposes. Paid subscriptions and audits are offered to business customers, not for personal, family, or household use. You must be at least 18, or the age of legal majority where you live if higher, and able to enter a binding contract. Rights that applicable law does not allow you to waive remain unaffected.
2. Services and authorised scanning
SchemaCart may provide:
- Free URL scans: an automated readiness scan of an authorised public URL, an on-screen summary, and an email-gated report;
- Monitoring subscriptions: repeated checks and change reports at the frequency, limits, and price displayed before an order; and
- One-time audits: the work and deliverables stated in an accepted order form, statement of work, or checkout description.
Published plan or order terms state the scope, scan allowance, monitoring frequency, report access, price, and any other limits. SchemaCart does not charge an undisclosed overage: work beyond an allowance requires your approval or waits until the allowance resets. Free scans may be rate-limited by IP address and domain.
You may submit a site only if you own, administer, or manage it, or have express permission from its owner or authorised administrator. Each submission repeats that promise.
The scanner makes sequential, low-volume requests—typically about six per scan—to public resources needed for its checks. It identifies itself as “Mozilla/5.0 (compatible; GEO-Checker/0.1; internal audit tool)”. It accepts HTTP or HTTPS public domain names, rejects embedded credentials and IP-address targets, checks the submitted hostname for private or non-public addresses, applies time limits, and reports robots.txt and access-control signals. SchemaCart may refuse, stop, or limit access after a robots or operator objection, an access block, a rate-limit response, repeated errors, or another legal, security, or operational concern.
3. Acceptable use
You must not use or try to use the Services to:
- scan a site without the ownership, authority, or express permission required above;
- access authenticated, private, restricted, paywalled, or non-public resources;
- submit credentials, tokens, cookies, private URLs, or payment details;
- bypass a CAPTCHA, access control, robots restriction, rate limit, paywall, or IP block;
- submit forms, attempt passwords, probe ports, test vulnerabilities, or conduct penetration testing;
- collect or build a dataset of personal information about other people;
- interfere with, overload, damage, reverse engineer, or gain unauthorised access to a service or system;
- evade quotas, automate excessively, resell access, or misrepresent a report; or
- break the law, another person’s rights, a contract binding on you, or a target site’s applicable terms.
You must stop promptly if a site owner withdraws permission or objects. Report a suspected account or service compromise to ben@schemacart.com.
4. Your inputs, reports, and measurement limits
You keep any rights you have in URLs, instructions, files, feedback, and other material you provide (“Customer Inputs”). You confirm that you have the rights and permissions needed for SchemaCart to process them.
You give SchemaCart a worldwide, non-exclusive, limited licence for the time reasonably needed to host, transmit, fetch, analyse, transform, store, and display Customer Inputs solely to provide and secure the Services, deliver scans and audits, respond to support, comply with law, enforce these Terms, and improve the Services using aggregated or de-identified information. SchemaCart does not use Customer Inputs or scan results to train machine-learning models.
Reports, scores, findings, recommendations, and alerts are automated or analyst-assisted, point-in-time readiness measurements. They can miss a condition, misunderstand content, or contain a false positive or false negative. They are informational and do not provide legal, privacy, cybersecurity, financial, tax, accessibility, or other professional advice.
Search engines, AI platforms, crawlers, marketplaces, and target sites are independent third parties. SchemaCart does not control their policies, availability, access decisions, indexing, retrieval, algorithms, or outputs. The Services do not promise rankings, indexing, traffic, mentions or citations by an AI system, visibility, conversion, revenue, or any other technical or commercial outcome. A score or passed check means only that the measured condition met SchemaCart’s criteria at the time tested.
5. Paid services, cancellation, and refunds
SchemaCart does not currently process payments. Before accepting a paid order, the order or checkout will state the provider, price, currency, billing interval, renewal, included usage, taxes, payment timing, and any promotion. No free scan converts automatically to a paid service.
If a subscription is introduced, it renews for the disclosed period until cancelled. You may cancel by emailing ben@schemacart.com or through any cancellation control made available in the Service. Cancellation stops future renewal and takes effect at the end of the paid period unless an order or mandatory law provides otherwise. Unused allowances do not carry over, have no cash value, and end with the applicable period. Report access continues through the paid period and for 30 days afterwards.
Fees already charged are non-refundable except where the order says otherwise or law requires a refund. We refund duplicate or erroneous charges and prepaid fees for a Service we do not provide. Approved refunds are issued to the original payment method within 14 days. A price change requires at least 30 days’ advance notice and applies no earlier than the next renewal.
Paid Services are offered for business use. If mandatory consumer law nevertheless applies, its withdrawal, renewal, cancellation, refund, and service-quality rights remain unaffected.
6. One-time audits
An audit is a customised professional service that may include a digital report. Its accepted order must state the target, scope, deliverables, assumptions, dependencies, expected delivery date, revision allowance, price, and acceptance criteria. Unless the order says otherwise, one reasonable correction round is included to bring a deliverable within scope. A deliverable is accepted when you approve or use it, or do not identify a material departure from the acceptance criteria within seven days after delivery.
You may cancel for a full refund before work starts. After work starts, SchemaCart may retain the proportion of the fee attributable to completed milestones or documented time, plus non-cancellable costs. Any prepaid amount for undelivered work is refunded within 14 days. After final delivery, the fee is non-refundable unless the deliverable materially departs from the agreed scope and is not corrected within a reasonable time, or law requires otherwise.
7. Suspension and termination
You may stop using the Services or request account closure by emailing ben@schemacart.com. We may limit, suspend, or terminate access for non-payment, a material breach, unauthorised or abusive use, a security threat, a provider restriction, a legal requirement, a site-owner objection, or material legal or operational risk.
Where practical and lawful, we will give notice and a reasonable opportunity to correct a remediable breach. We may act immediately for an urgent security, fraud, legal, or unauthorised-scanning concern.
After termination, access ends. Completed reports remain downloadable for 30 days where an account feature supports downloads. Stored information is then handled under the Privacy Policy: service data is retained for no more than 24 months or until a verified deletion request, whichever comes first, and backups expire within 90 days. No continuing read-only account access is provided.
8. Intellectual property, report licence, and third parties
SchemaCart and its licensors own the Services, software, checks, scoring methods, report templates, documentation, and branding, excluding Customer Inputs and third-party material. These Terms do not transfer those rights.
Subject to applicable payment and these Terms, you receive a non-exclusive, worldwide, perpetual licence to use, copy, and share a report created for you inside your business and with advisers, contractors, or a client for whom you commissioned the report. Public publication, white-labelling, standalone resale, or removal of SchemaCart attribution requires prior written permission. You must not alter or present a report misleadingly.
The Services may rely on Cloudflare, Resend, Google Workspace, target websites, search engines, AI platforms, and other third-party products. They control their own systems, content, availability, terms, and privacy practices. Their names in a report do not imply endorsement, partnership, or certification.
9. Availability, privacy, and disclaimers
We may improve, add, remove, or change features. We will not materially reduce the core functionality of a paid Service during a paid term without reasonable notice unless an urgent security, legal, or provider reason requires it. The remedy for a material reduction that defeats the purchased purpose is cancellation and a proportionate refund for the unused period where applicable.
The Services can be interrupted by maintenance, internet failures, target-site blocks, provider outages, and events outside our reasonable control. Unless an accepted order expressly says otherwise, there is no service level, fixed support response time, or availability commitment; monitoring frequency is only the frequency stated in the order.
The Privacy Policy explains personal-data handling. You must use the Services consistently with privacy and data-protection law.
To the maximum extent permitted by law, the Services are supplied “as is” and “as available”. SchemaCart does not promise that they will always be available, secure, error-free, complete, current, or suitable for a particular purpose, or that every issue will be detected. Non-waivable statutory rights and duties, including any applicable duty to use reasonable care and skill, remain unaffected.
10. Your responsibility and limitation of liability
If you use the Services for a business, then to the extent permitted by law you will indemnify SchemaCart and Benjamin Ong against a third-party claim and reasonable resulting costs caused by a site you submit without required permission, unlawful or infringing Customer Inputs, your material misuse of a report, or your material breach of these Terms. We will give prompt notice, reasonable control of the defence, and reasonable cooperation. No settlement may admit fault by or impose an obligation on SchemaCart without written consent.
Nothing excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or another liability or right that law does not permit to be excluded or limited.
Subject to that sentence and to the maximum extent permitted by law, SchemaCart is not liable for indirect, consequential, special, incidental, exemplary, or punitive loss, or for lost profit, revenue, data, goodwill, anticipated savings, or business opportunity. SchemaCart’s total aggregate liability relating to the Services and these Terms is limited to the greater of the fees paid for the affected Service in the 12 months before the first event giving rise to the claim and HKD 500. These limits apply only where lawful and reasonable.
11. Governing law and disputes
These Terms and any non-contractual dispute arising from them are governed by Hong Kong law. For business users, the courts of the Hong Kong Special Administrative Region have exclusive jurisdiction. Either party may seek urgent protective relief in another court with jurisdiction. If mandatory consumer law applies, this clause does not remove protections or access to courts that cannot be waived.
Before filing a claim, email ben@schemacart.com with a short description so both sides can try in good faith to resolve it. These Terms do not require arbitration or prevent use of an available small-claims or consumer process.
12. Changes, general terms, and contact
We may update these Terms by posting a revised version with a new date. For a material change affecting an active paid Service, we will give at least 30 days’ advance notice through the Service or by email unless an urgent legal or security reason requires faster action. A change applies from its stated effective date and does not create a retroactive charge.
- Notices: We may send operational or legal notices to the email associated with a Service or display them in the Service. An email is treated as received on the next business day unless the sender receives a delivery failure; an in-service notice is received when displayed. Formal notices to SchemaCart must be emailed to ben@schemacart.com.
- Assignment: You may not transfer these Terms without written consent. We may transfer them with the relevant business if non-waivable rights are not reduced.
- Force majeure: Neither party is responsible for delay caused by events beyond reasonable control, except for amounts already due.
- Entire agreement: These Terms, the Privacy Policy, and accepted order terms are the complete agreement about the Services.
- Order of precedence: A signed agreement controls, then specific accepted order terms, then these Terms; the Privacy Policy controls personal-data handling.
- Severability and waiver: An unenforceable term is limited to the minimum necessary; the remaining terms continue. A delay in enforcement is not a waiver.
- No partnership: These Terms do not create employment, agency, a joint venture, a fiduciary relationship, or a partnership.
- Third-party rights: A person who is not a party has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce these Terms.
- Language: The Services and these Terms are offered in English. The English version controls to the extent permitted by law.
